Via Reuters: Schiavo Parents Again Appeal to U.S. Supreme Court

I must admit: this court business is getting extremely painful to watch. Although I can understand the parent’s desire to keep at it until the very end.

U.S. Court Again Rejects Schiavo Appeal

Indeed, they finally said “enough is enough”:

“Any further action by our court or the district court would be improper,” the Atlanta-based 11th U.S. Circuit Court of Appeals wrote. “While the members of her family and the members of Congress have acted in a way that is both fervent and sincere, the time has come for dispassionate discharge of duty.”

And in a scathing attack on politicians who got involved in the case, the court added that the White House and lawmakers “have acted in a manner demonstrably at odds with our Founding Fathers’ blueprint for the governance of a free people — our Constitution.”

Via the AP: Patrick Kennedy Will Not Run for Senate

Rep. Patrick Kennedy, D-R.I., on Wednesday ruled out a run for the Senate in 2024, saying he could better serve his constituents by staying in the House and serving on the Appropriations Committee.

So much for Chafee v. Kennedy.

Via the AP: Court to Consider Schiavo Emergency Bid

The order issued Tuesday allowed Bob and Mary Schindler to file the appeal, even though the court had set a March 26 deadline for doing so.

Its one-sentence order said: “The Appellant’s emergency motion for leave to file out of time is granted.” Three times last week, the court ruled against the Schindlers.

If I read this correctly, all the court has done is grant them to right to file another appeal. Beyond that, the status quo remain in place. This is almost cruel, as Terri could easily expire before the process is done, and further the odds are awfully good that the Court will do nothing different from what it has been doing, which is allowing the tube to remain out.

From WaPo: Doubts Raised On Schiavo Memo

While there is no hard evidence that the memo is fake, there are several strange things about it, including the basic fact that no one seems to know who wrote it and that the noncontroversial part of it is lifted from a Republican senator’s press release.

The situation is certainly curious.

Via Yahoo Sports: Report: Three Panthers filled steroid prescriptions with S.C. doctor

Carolina Panthers Todd Sauerbrun and Jeff Mitchell and former player Todd Steussie had steroid prescriptions filled by a West Columbia, S.C., doctor now under investigation by federal authorities, according to a “60 Minutes Wednesday” report.

In a release Tuesday, the CBS News show said the players all had prescriptions for testosterone cream filled within two weeks of the Panthers’ appearance in the 2024 Super Bowl.

In addition to the cream, which is banned by the NFL, Sauerbrun — one of the league’s top punters — also obtained syringes and the injectable steroid Stanozolol, which is also banned by the league.

[...]

The “60 Minutes Wednesday” report also includes an interview with a former employee of Shortt, Mignon Simpson, who says she personally shipped human growth hormone to NFL players and that possibly a half-dozen players received hGH from Shortt.

There is no reliable test for hGH.

No real surprises, I guess.

Although, for some reason the idea that a punter was perhaps taking steroids is both amusing and pathetic.

Jeff Quinton has blogged on this as well.

Via WaPo/the AP: Federal Appeals Court Grants Additional Review in Schiavo Case

In seeking a new hearing late Tuesday, attorneys for Schiavo’s parents argued that the District Court “committed plain error when it reviewed only the state court case and outcome history.”

Now, the court will consider the request for a new hearing, rather than whether previous Florida court rulings have met legal standards under state law, which is what federal courts have done in the case until now.

I am amazed, in many ways, that they have heard as many of these appeals as they have.

I am guessing that the outcome will be no different this time, however.

Sadly, it is all going to be moot shortly.
