The flavor du jour for the top of Bush’s list to replace Miers is Samuel A. Alito Jr. .
If anything, he is radically more qualified than Miers (and that is putting it mildly). He also would clearly be far more palitable to conservatives.
And, of course, this would raise huge red flags for some on the Left:
On abortion, Alito was the lone dissenter in Planned Parenthood v. Casey, in which the 3rd Circuit struck down a Pennsylvania law that required women seeking abortions to inform their husbands.
To be honest, opposition to Casey would be more of a threat to the current legal regime on abortion rights than would generic oppostion to Roe.
Could it be enough for a filibuster?
That fact that his nickname is “Scalito” can’t help.
